Your personal data will be processed by:
MarineTeknik Inc., Florida, MarineTeknik, 947 NW 31st Ave, Pompano Beach, FL 33069, United States of America (“US MarineTeknik”) as a data controller.

Purpose and legal basis of personal data processing

The legal basis for the processing of your personal data is, to the extent appropriate, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), referred to as the “GDPR”.
We process your personal data for the purpose of :
1) performance of the contract between you and MarineTeknik, including the performance of actions necessary prior to the conclusion of the contract, i.e. on the basis of Article 6(1)(b) of the GDPR;
2) management of services provided by MarineTeknik USA, the entity that processes data in a so-called third country, where personal data protection is generally lower than in the EU, on the basis of your consent to the processing of data in the USA and to transfer the data to other entities worldwide, i.e. Article 6(1)(a) of the GDPR;
3) processing of complaints, handling inquiries before and during the performance of the contract, i.e. on the basis of Article 6(1)(b) of the GDPR;
4) exercise of legitimate interests pursued by MarineTeknik, i.e. on the basis of Article 6(1)(f) of the GDPR, including:
A) data processing for the management of the team of MarineTeknik’s cooperating parties, including handling the payment of salaries and assignment of tasks, where the legitimate interest is to optimise and handle the involvement of MarineTeknik cooperating parties;
B) processing for analytical and statistical purposes where the legitimate interest is to keep archives and evaluate historical data for the purpose of optimisation;
C) recording access to MarineTeknik’s office, where the legitimate interest is to ensure security within MarineTeknik’s premises;
D) direct marketing of MarineTeknik’s own goods or services where the legitimate interest is to obtain new orders;
E) handling potential claims of MarineTeknik or against MarineTeknik, where the legitimate interest is to defend against claims and conduct proceedings.

Obtaining of personal data

If you have provided us with your personal data on your own initiative, we would like to inform you that providing such data is voluntary, but necessary for MarineTeknik to carry out the activities in connection with which you provide us with your personal data.
We were also able to obtain your personal data from business partners or from publicly available business registers based on MarineTeknik’s legitimate interest in developing a database of cooperating parties.

Data recipients

The recipients of your personal data will be, among others, the entity capital-related and organisationally linked to MarineTeknik USA, i.e. MarineTeknik sp. z o.o. with its registered office in Pruszcz Gdański, which acts as a processing entity, as well as external service providers, e.g. entities providing IT services, companies providing accounting services and auditors, persons providing legal services, administrative bodies, courts and other bodies authorised to receive data on the basis of legal regulations or final judgments and decisions, and also clients of MarineTeknik USA.

Processing of data in a third country

Your data are processed in a third country within the meaning of the GDPR, i.e. the United States and potentially in other countries.

The United States and other third countries within the meaning of the GDPR are considered by the European Commission as not providing an adequate level of data protection in line with European Union standards. Therefore, the transfer of your data to Marinteknik USA’s business partners will be subject to your consent.

Processing period

Your personal data will be processed for the period necessary to achieve the purpose for which you have made your data available or provided to us, but no longer than until the expiry of the limitations period for claims relating to the circumstances surrounding the processing of data, and for marketing, analytical and statistical purposes, until you object to the processing of data for these purposes.

Your rights

We would like to inform you that you have the right to request access to your data, rectification, deletion or restriction of their processing and the right to object to the processing and to transfer your data. You are also entitled to make other requests concerning your data. For all matters relating to the processing of personal data, please contact us through the contact details provided below.

Data protection supervisory authority

We would like to inform you that if you consider it appropriate, you have the right to lodge a complaint in relation to the processing of your data with the supervisory authority, i.e. the President of the Personal Data Protection Office.

Information on automated processing, including profiling

We do not process your personal data automatically, including profiling.
