Data controller

Your personal data is processed by:
MarineTeknik sp. z o.o. with its registered office in Pruszcz Gdański, at ul. Batalionów Chłopskich 7, 83-000 Pruszcz Gdański, Poland (“MarineTeknik”) as a data controller.

Purpose and legal basis for personal data processing

The legal basis for the processing of your personal data is, to the extent appropriate, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), referred to as the “GDPR”, and the provisions of the Labour Code of 26 June 1974.

We process your personal data for the purpose of:

1) conducting of the recruitment process to the extent indicated in the provisions of the Labour Code and to the extent necessary to take actions before conclusion of a contract, i.e. on the basis of Article 6(1)(b) and (c) of the GDPR, and with regard to other data which you voluntarily provide and when you agree to the processing of your data also for future recruitments, will be processed pursuant to your consent, i.e. on the basis of Article 6(1)(a) of the GDPR, which consent can be revoked at any time, which will not affect the lawfulness of the processing, which was carried out on the basis of your consent before its revocation;

2) fulfilment of obligations imposed by law, e.g. regulating the process of hiring employees, i.e. on the basis of Article 6(1)(c) of the GDPR.

3) recording access to MarineTeknik’s registered offices when you visit the same, i.e. on the basis of Article 6(1)(f) of the GDPR, where the legitimate interest is to ensure security within MarineTeknik’s registered office;

4) exercising of legitimate interests pursued by MarineTeknik or MarineTeknik USA, i.e. under Article 6(1)(f) of the GDPR, including the handling of potential claims against MarineTeknik or MarineTeknik USA, where the legitimate interest is to defend against claims and conduct proceedings;

5) analytical and statistical purposes, i.e. on the basis of Article 6(1)(f) of the GDPR, where the legitimate interest is to keep archives and evaluate historical data.

Voluntary provision of personal data

We would like to inform you that the provision of your data under the Labour Code is voluntary, but necessary for the consideration of your application and participation in the recruitment process.
DATA PROCESSED UNDER LEGAL REGULATIONS
We would like to inform you that, on the basis of legal regulations (Article 22(1) §1 of the Labour Code), in connection with the recruitment process, MarineTeknik is entitled to process personal data including:
1) first and last name(s);
2) date of birth;
3) contact details indicated by the applicant;
4) education;
5) professional qualifications;
6) the course of previous employment;
while the data listed in points 4, 5 and 6 above will be proposed only if it is necessary for performance of a given type of labour or holding a given position.
The provision of data beyond the scope of the Labour Code is also voluntary and requires your express consent. Please note that failure to provide the aforementioned additional data will not have any negative consequences for your candidacy.

Data recipients

Recipients of your personal data will be, among others, the entity which is capital-related and organizationally connected with MarineTeknik, i.e. MarineTeknik USA, as well as, if necessary, external service providers, e.g. entities providing IT services, companies providing accounting services, persons providing legal services, administrative bodies, courts and other bodies entitled to receive data on the basis of legal regulations or final judgments and decisions.

Transfer of personal data to a third country

Given the organisational link between MarineTeknik and US MarineTeknik, your data will be transferred to a third country, i.e. to the United States.

The United States is recognised by the European Commission as not providing an adequate level of data protection in line with European Union standards. Therefore, any transfer of your data will be subject to safeguards – standard data protection clauses adopted by the European Commission. A copy of these clauses can be obtained by contacting MarineTeknik through the contact details given above.

Processing period

Your personal data will be processed for the period necessary to achieve the purpose for which you have made your data available or provided us with it, but no longer than for one year following the completion of recruitment process. If you do not specify a different date in your consent to process your data for the purpose of future recruitments, they will be processed for one year.

Your rights

We would like to inform you that you have the right to request access to your data, rectification, deletion or restriction of their processing and the right to object to the processing and to transfer your data. You are also entitled to make other requests concerning your data.

Data protection supervisory authority

We would like to inform you that if you consider it appropriate, you have the right to lodge a complaint in relation to the processing of your data with the supervisory authority, i.e. the President of the Personal Data Protection Office.

Information on automated processing, including profiling

We do not process your personal data automatically, including profiling.

as a separate data controller.

Other information

The information provided above with respect to the period of processing, your rights, the supervisory authority, and automated data processing shall apply to the processing of data by MarineTeknik USA.
